Law No. 379 of 14 December 2000 provides for the recognition of Italian citizenship in favor of individuals born and residing in the territories of the former Austro-Hungarian Empire, as well as their descendants, provided that they meet the necessary requirements.
The deadline for submitting applications under Law 379/2000 expired on 19 December 2010.
Law No. 124 of 8 March 2006 allows for the recognition of Italian citizenship to compatriots who lost it due to residing in Istria, Fiume, and Dalmatia between 1940 and 1947.
Recognition of citizenship based on these special laws constitutes acquisition of citizenship by operation of law (beneficio di legge). As such, it is not possible for a parent who acquired citizenship through these laws to make a declaration of intent for the acquisition of citizenship on behalf of a minor child, as provided for under Article 4, paragraph 1-bis of Law No. 91/1992, because such a parent is not an Italian citizen by birth.
